1. Acceptance of the Terms
By accessing and using the website fgafitness.com (the "Site") to purchase training plans, products, or any service offered by Fernando Gaviria Fitness ("FGA Fitness," "we," "us," "our"), you ("User," "Customer") agree to be bound by these Terms and Conditions. If you do not agree, you should not use the Site or purchase our services.
2. Services Offered
FGA Fitness offers:
Personalized Training Services: Including, but not limited to, the creation and monitoring of personalized plans such as the "333 System", exercise and nutrition advice via online.
Product Sales: Marketing of nutritional supplements, sportswear and other fitness-related products through the online store.
3. Account Registration and Security
To make purchases or access certain services, you must create an account by providing accurate and up-to-date information. The account is personal and non-transferable. You are responsible for maintaining the confidentiality of your password and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Purchase Process, Prices and Payments
Orders: When you place an order, you are making a purchase offer. Acceptance occurs when we send the order confirmation.
Prices: Prices are shown in the Site's local currency (MXN, USD, etc.) and include applicable taxes (such as VAT in Mexico or sales tax where applicable). We reserve the right to correct pricing errors.
Payment: Payment is made at the time of purchase through the available payment gateways. You guarantee that you have the necessary funds.
5. Subscription Policies (if applicable)
For training plans or recurring products:
The subscription is automatically renewed in the chosen cycle (monthly, quarterly, etc.).
You can cancel your subscription at any time from your account dashboard or by contacting customer service. Cancellation will prevent the next renewal, but you will not receive a refund for the current paid period.
6. Shipping, Returns and Guarantees
Shipping: Delivery times are estimates. Import costs and taxes (for international shipments) are the responsibility of the customer.
Returns: We accept returns of non-perishable products in their original packaging within 30 calendar days of receipt for manufacturing defects or shipping errors. Training plans and downloadable digital services are non-refundable, except as provided by local law.
Results Guarantees: The results of training plans and supplement use vary depending on each person's commitment, metabolism, and individual circumstances. FGA Fitness does not guarantee specific results.
7. Limitation of Liability
Consult a healthcare professional: The client declares that they are physically fit to exercise and have consulted with a doctor. Supplements are not medications.
Disclaimer of liability for damages: To the maximum extent permitted by law, FGA Fitness will not be liable for any indirect, incidental, or consequential damages (such as loss of profits) arising from the use of our services or products.
Responsibility for training: The client understands the risks inherent in physical activity and participates at their own risk.
8. Intellectual Property
All content on this Site (logos, text, the "333" method, videos) is the property of FGA Fitness or its licensors and is protected by copyright. It may not be used without express written permission.
9. Applicable Law and Conflict Resolution
These terms will be governed by the laws of the State of Florida, United States (or the jurisdiction where FGA Fitness has its principal place of business). Any dispute will be resolved in the competent courts in that location, unless otherwise required by the consumer protection laws of your country of residence.
